FOSAMAX CLASS ACTION LAWSUIT
April 12, 2006 - Lawyers filed a class action lawsuit against the manufacturer of Fosamax, a drug used to treat osteoporosis. Fosamax has been linked to to jaw osteonecrosis, or "jaw death." The lawsuit against Merck & Co., filed Wednesday in U.S. District Court in Fort Myers, seeks undetermined damages for problems linked to the drug. The suit also asks for attorney fees, a medical monitoring program and an order to Merck to warn consumers about potential side effect from Fosamax. A similar lawsuit was filed last week in Tennessee. Lawyers argue Merck knew Fosamax could cause bone loss in the jaw but refused to change labeling because it could mean a profit loss. Officials originally believed osteonecrosis, defined as a rotting jaw, was confined to specific chemotherapy drugs. Fosamax and the chemotherapy treatments are in the same class of drugs. On Aug. 25, 2004, the United States Food and Drug Administration found other drugs in this class also cause problems with rotting jaws.
